Terms and Conditions of Sale

1. Scope

These terms and conditions of sale (T&Cs) apply to all design, writing, design and production services for card decks provided by CHIC MAKER, a French SARL with share capital of €5,000, RCS Nanterre 751 089 947, VAT FR11751089947, publisher of The Deck Factory, for its professional and consumer clients. Any order implies full and unreserved acceptance of these T&Cs.

2. Description of services

Chic Maker offers:

• a design package including editorial architecture, card writing, art direction and creation of production files;
• a production service including printing, finishing and delivery of the decks, in the quantities and specifications agreed in the quote.

The details of each service are defined in the quote accepted by the client. Services are invoiced in two stages: design on one hand, production on the other.

3. Price and payment

Prices are shown in euros excluding tax (excl. VAT). The design package is set at €3,990 excl. VAT. The production price is calculated based on the unit rate applicable to the quantity ordered, starting from €9.99 per deck for a minimum of 500 copies. Rates may be revised via a custom quote depending on finishes, volumes and specific options.

A 50% deposit is required for the design package. Production is invoiced upon firm production order. Payments can be made by bank transfer or any other means agreed in the quote.

4. Quotes and orders

Every service is subject to a custom quote. The quote is valid for the period indicated on it. The order is firm upon written acceptance of the quote (signature or email) and payment of the deposit, where applicable.

5. Timeframes

Delivery timeframes are provided for guidance in the quote. Chic Maker undertakes to comply with the agreed contractual timeframes, provided that the client supplies all elements necessary for the proper performance of the service. Production timeframes may vary depending on the printer's capacity and the options chosen.

6. Revisions and approvals

The design package includes two rounds of revisions. Any request for changes requiring additional work, or any modification after approval of the production files, may be invoiced as an additional cost based on a quote.

7. Intellectual property

The client remains the owner of all its content, trademarks and elements provided. Chic Maker grants the client, after full payment of the design package, the rights of use and reproduction over the graphic and textual creations made specifically for the project. Chic Maker's template elements, methodology and process remain its exclusive intellectual property.

8. Delivery and transport

Delivery is deemed to have taken place upon handover of the package to the carrier. The risks of loss or damage are transferred to the client at that date. Delivery within mainland France is included for standard orders. International deliveries and express shipments are subject to a specific quote.

9. Right of withdrawal

For non-professional clients, the 14-day right of withdrawal applies to design services subject to article L.221-28 of the French Consumer Code. Once the design services have been fully performed with the client's agreement, the right of withdrawal can no longer be exercised. Production services are custom-made and are not eligible for the right of withdrawal.

10. Liability and warranty

Chic Maker guarantees that the services comply with the approved quote. Chic Maker's liability is limited to direct and foreseeable damages. It cannot be held liable in the event of delay or non-conformity attributable to the client or a third party.

11. Dispute resolution

These T&Cs are governed by French law. In the event of a dispute, the parties will endeavour to find an amicable solution. Failing that, the competent courts will be those of the jurisdiction of Chic Maker's registered office, unless otherwise required by mandatory legal provisions.
